- в Бельгии, Швеции, Швейцарии и некоторых других странах местное законодательство разрешает участникам арбитражных споров, рассматриваемых на территории этих государств, заключать между собой соглашения, ограничивающие их право на оспаривание арбитражного решения в государственном суде этой страны по сравнению с предусмотренными законами этого государства общими основаниями для отмены арбитражного решения (см. action to set aside). Условием правомерности заключения такого соглашения всегда является отсутствие в числе участников спора физических и юридических лиц, домицилированных в государстве, на чьей территории будет вынесено арбитражное решение (seat of arbitration). Таким образом дополнительно ограничивается возможность добиваться отмены арбитражного решения, чем повышается привлекательность этих стран как места проведения международных арбитражей с участием иностранных компаний. Зачастую waiver agreement составляют часть арбитражной оговорки, включаемой в договор при его разработке задолго до возникновения спора. waiver agreement не могут касаться оснований для оспаривания арбитражных решений, связанных с аргументами о нарушении публичного порядка (public policy). Российским правом возможность заключения таких соглашений не предусмотрена. См. также п. 6 ст. 28 Арбитражного регламента МТП (ICC Rules).
