exclusion agreement
- соглашение сторон об отказе от использования определенных оснований для оспаривания арбитражных решений (см. action to set aside). Обычно закрепляется в арбитражном соглашении. Например, если арбитражное разбирательство осуществляется в Англии и спорное правоотношение подчинено английскому материальному праву, стороны имеют право на основании exclusion agreement отказаться от возможного оспаривания арбитражного решения по мотивам неправильного применения составом арбитража материального права. Способствует ограничению гипотетических возможностей по оспариванию арбитражного решения после его вынесения и повышению привлекательности соответствующего государства как места для проведения международных арбитражей.
