capacity to be a party to arbitration
- способность лица выступать в качестве стороны арбитражного разбирательства, процессуальная правоспособность лица с точки зрения права, которому подчинено проведение арбитражного разбирательства. Данный вопрос чаще всего разрешается не по lex contractus или lex societatis. а на основании норм lex arbitri. В современном законодательстве развитых государств ограничение права на заключение арбитражных соглашений встречается очень редко и только в отношении государственных и квазигосударственных образований. Процессуальная правоспособность часто сопоставляется с материально-правовыми аргументами, находящимися в распоряжении стороны (см. standing to sue or to be sued).
