sovereign immunity
- суверенный иммунитет, иммунитет государства, не позволяющий подавать против него иски в суды и арбитражи и приводить в исполнение судебные и арбитражные решения. В литературе выделяют абсолютный и функциональный иммунитеты, см. iure imperii, iure gestionis. В России и ряде других стран основной проблемой является отсутствие четкой регламентации порядка, в котором государство может отказаться от права ссылаться на наличие у него суверенного иммунитета, в последнее время предпринимаются попытки решить эту проблему на международном уровне, см.
