second look doctrine
- дословно "доктрина второго взгляда", доктрина, основанная на выводах Верховного Суда США по делу Mitsubishi Motors Corp. v. Soler Chrysler Plymouth Inc. (решение от 2 июля 1985 г.), в соответствии с которой американский суд должен направлять по просьбе сторон в международный коммерческий арбитраж споры, которые не являются арбитрабильными (см. arbitrability) для внутренних третейских судов, но при этом сохраняет за собой право в процессе приведения в исполнение арбитражного решения проверить его с точки зрения соблюдения норм антитрестовского законодательства в рамках доктрины позитивного публичного порядка (см. positive public policy). Принятие Верховным Судом США этого решения существенно расширило полномочия международных арбитражей по рассмотрению споров, в том числе связанных с соблюдением норм публичного (антимонопольного и антитрестовского) законодательства.
