merits
- существо спора. Термин, содержание которого обычно противопоставляется спорам, ведущимся вокруг вопроса о наличии у состава арбитража права на разрешение вынесенного на его рассмотрение спора (jurisdiction of arbitral tribunal). Данный термин обычно используется для того, чтобы подчеркнуть невозможность пересмотра существа арбитражного решения в процессе его оспаривания и/или приведения в исполнение.
