fact v. law
- сопоставление подлежащих установлению в ходе разбирательства вопросов, связанных с фактическими обстоятельствами дела, с вопросами права. Как правило, этот принцип означает, что установленные арбитражем фактические обстоятельства могут в рамках процесса оспариваться в меньшей степени, нежели правовые позиции, сформулированные сторонами.
