- свидетель-эксперт, обычно таким термином именуют экспертов, назначенных сторонами арбитражного разбирательства (party-appointed expert). В отличие от свидетелей, которые сообщают составу арбитража сведения о фактических обстоятельствах, связанных со спором, свидетель-эксперт готовит заключение, основанное на его профессиональных знаниях в какой-либо области, при подготовке которого необходимые сведения фактического характера сообщаются ему стороной, которая его назначает. Обычно заключение свидетеля-эксперта представляется в письменной форме (см. expert’s report), а в ходе устного слушания он подвергается перекрестному допросу (cross-examination). Для того, чтобы арбитры доверяли сведениям, сообщенным таким экспертом, он должен продемонстрировать профессионализм и независимость своих суждений от позиции стороны, которая привлекла его к участию в деле.
