- последовательное применение методов разрешения спора, правило, в соответствии с которым стороны сперва пытаются разрешить свой спор путем переговоров (negotiation), потом путем медиации или примирения (ADR), и лишь потом обращаются в арбитраж (arbitration). Хотя на практике рекомендуется именно такая последовательность в обращении к различным методам разрешения спора, специалисты не советуют включать в договоры положения, препятствующие обращению в арбитраж до завершения попыток урегулирования разногласий путем ADR.
